CONDITIONS OF USE
By using this site, you agree to all of the following conditions. If you do not agree to all of these conditions, you may not use the FamilySearch Labs Internet site. We may change these conditions from time to time, so you must check for changes when you use the site. Your continued use of the site following the posting of changes to these conditions means that you accept those changes.
FamilySearch/GSU Licenses. This site is owned and operated by Genealogical Society of Utah (GSU), a nonprofit organization created by the Corporation of the President of The Church of Jesus Christ of Latter-day Saints (hereafter referred to as "the Church"). GSU is dedicated to family history and genealogical research. All material on this site (including text, images, databases, and other information) is owned or licensed by GSU. You may view, download, and print material from this site only for your personal, noncommercial use unless we specifically indicate that other uses are permitted. You may not use this site or information found at this site (including the names and address of those who submit information) for selling or promoting products or services, soliciting clients, or any other commercial purpose.
Notwithstanding the foregoing, we reserve the right, at our sole discretion, to deny, revoke, or limit use of this site to any person. GSU is not responsible for any use that you make of materials from this site, and you agree to fully indemnify GSU for any claims against GSU based on your actions. In many instances, we do not provide source citations, and in no case do we guarantee that materials on this site are legally available for any use beyond personal, noncommercial genealogical research.
Registration Obligations. In consideration for the use of FamilySearch Labs, you represent that you have read and agreed to these Conditions of Use and that you are legally able to register to use FamilySearch Labs. You agree to (A) provide true, accurate, current, and complete information about yourself (as indicated during the FamilySearch Labs registration process) and (B) maintain and keep current and accurate this information about yourself, should it ever change. If you knowingly provide false, inaccurate, inappropriate, or libelous information or images, GSU has the right to suspend or terminate your account. During the registration process, you will be asked to create a sign-in name and password. You are responsible for maintaining the confidentiality of the sign-in name and password. You agree that you are responsible for all activities that occur using this sign-in name and password. If someone else uses your sign-in name and password in such a way as to breach the terms of this Agreement, you remain responsible for his/her actions, and use of your sign-in name may be suspended or terminated.
License to Use. In exchange for your use of FamilySearch Labs and storage of the data you submit, you give us permission to use any genealogical data relating to deceased persons that you submit to FamilySearch Labs and to copy and distribute it throughout the world by any means we deem appropriate, electronic or otherwise, including the Internet, without compensation to you of any kind. You grant to us an unrestricted, royalty-free, world-wide, perpetual license to any copyright or database right that you may hold in your contributed data, and you also grant to us the right to create derivative works by combining your data with that of other contributors.
Collaboration with Others. You acknowledge that a primary purpose of FamilySearch Labs is to enable collaboration between users of FamilySearch Labs who wish to expand their knowledge of their own ancestral lines. You acknowledge that GSU may utilize genealogical data that you submit relating to deceased persons for the purpose of collaborating with other organizations (including commercial genealogical organizations) in order to create a global common pedigree for the purpose of increasing participation in family history and preserving the records of the world. You acknowledge that collaboration between organizations allows GSU to obtain additional data which will be provided freely to all users of FamilySearch Labs, thus allowing them to extend their own ancestral lines. The FamilySearch Labs Privacy Policy provides more details regarding our use of your data.
Linking. For your convenience, this site may contain links to Web sites operated by others. These sites are not maintained or controlled by us, and we are not responsible for their content. Although we have made a good faith effort to link only to sites containing appropriate and useful information, some may contain inappropriate or objectionable material. If you find such material while using this site, please notify us so that we may remove links to such material. Information made available on the Internet becomes publicly and widely available. Therefore, linking to other sites is generally permissible under the law and consistent with the expectations of those using the Internet. However, if access to a particular site should be restricted, the site operator should promptly notify us.
Permission from Living Persons. Whenever you contribute genealogical data to FamilySearch Labs, you affirm that you have received permission from all living persons whose data you are contributing to give their personal information to FamilySearch Labs and GSU under the terms of this Agreement. You are the only one that can view information that you contribute about living persons.
Publishing Your Name. You give us permission to publish the name you select during registration (your "Contact Name") to identify you, with the level of anonymity you select, as the contributor of information on deceased persons that other users may view. By selecting preferences within FamilySearch Labs, you may grant us permission to share your personal information with other users of FamilySearch Labs. Please review our Privacy Policy to understand how we treat your personal information. Publication of any personal data you provide may include sending it to countries that have data privacy laws that are less restrictive than those in effect where you live. Your local laws may also give you special rights to have your personal information corrected or removed from FamilySearch Labs, but this will not affect the license you grant to us regarding the genealogical data that you contribute.
Right to Submit. Whenever you submit data to FamilySearch Labs, you are affirming that you have the legal right to contribute that data to us and to grant us the rights set out in this Agreement. You accept legal responsibility for FamilySearch Labs and GSU using your contributed data based on your affirmation. You are solely responsible for all content that you contribute and post to FamilySearch Labs.
Submitting Names for LDS Temple Ordinances. The policy of the Church is that members' preeminent obligation is to perform vicarious temple ordinances for their own deceased family members. You may perform family history research on natural, adoptive, and sealing lines. You also may submit names of persons who have a probable family relationship that cannot be verified because the records are inadequate, such as those who have the same surnames and resided in the same areas as known ancestors.
Names of nonrelated persons should not be submitted, including names of celebrities or famous people, or those gathered from unapproved extraction projects, such as Jewish Holocaust victims.
Code of Conduct. You agree that you will not individually, or as part of any collective effort, submit or post information to FamilySearch Labs that could be deemed harmful or offensive to other users, nor will you impersonate another user in order to hide your identity or implicate another in such actions. You agree to do nothing that might disrupt the flow of data to and from FamilySearch Labs, impact the service or performance of FamilySearch Labs, or circumvent any of the controls or usage rules that we have implemented. You understand that the result of harmful or offensive actions may include revocation of your right to use FamilySearch Labs and legal action against you.
Care of Submissions. We intend to use reasonable efforts to preserve the integrity of your genealogical data contributions and to avoid errors or omissions in the content of FamilySearch Labs. However, you agree that GSU shall be neither responsible nor liable for errors or omissions in any content you may find on FamilySearch Labs, nor for loss, damage, or corruption of genealogical data that you submit or post.
Legal Status and Jurisdiction. You affirm that you are age 12 or older. You understand that this Agreement is governed by the laws of the State of Utah, and the laws of the United States of America, without regard to those jurisdictions' conflicts of law principles. You agree that any legal action you bring against GSU or any matters related to this site shall be brought in either the state or federal courts located in
Limitations of Liability. GSU shall not be liable for special or consequential damages resulting from your use of, or your inability to use, this site, the materials in this site, or any linked site, including, but not limited to, lost profits, business interruption, and loss of programs or other data on your information handling system. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or any linked site.
